I did whole-heartedly agree with your post, until I had a look at the picture above it. On the basis of that evidence I think a ban would be harsh as it is clear that Phil is just showing some early support for the Scots by indulging in a little on-pitch Highland Fling. All he needs is a tartan skirt and a furry sporan and people would start calling him Phil McVickery.
